In arbitration, both sides state their position, witnesses may be called, and the arbitrator can probe both sides as appropriate (McLean and Williamson, 2008).Conclusions- Since the case involved two different aspects of law; civil rights and employment, arbitration and/or mediation would have been a wise choice. It is not clear if the company or Whitt was hostile to that, but it is clear that the two sides dramatically differed in their viewpoints. If Whitt was aware of the "at will" provision, which it appears she was, then there really was a difficult decision regarding her termination in the eyes of the law. However, none of this really addresses the moral and ethical responsibility of Harris Teeter, Inc. when a complaint is made regarding a hostile work environment or sexual harassment. Both issues should be part of their company training, employee manual, and HR procedures.
