Administrative law is a much smaller piece of national security, and therefore, its objective is to prevent civil society from committing civil crimes. Administrative law has undergone significant levels of changes in the recent past. The current shape of administrative law does not permit judges and juries to issue a death sentence to the criminal except in severe cases of serial killings and terrorism. Theology and religious literature have influenced the current form of administrative law that presently believes in the value of providing an opportunity of experiencing Grace of God. The law enforcers can create temporary regulations in order to protect public, governmental officials and property from harm.

Maintaining Balance of Agency Power

Modern psychological studies revealed the fact that humans succumb to violence when their ability to love decreases. Violence and hate are nothing more than the absence of love. Prisoners in developed nations attend courses of personal development. The judicial review boards have a job of keeping decisions valid, so that agencies do not manage to gather inappropriate power, and they should act within the limits of the law. The right and authority of legislation resides with the political leadership of the country, and law enforcement agencies cannot create new laws on their own. They have to implement preexisting laws only (Stewart, 1975). Administrative laws are sources of implementing constitution of the country. Law enforcement officers have to keep their cleanliness of character intact, and they have to posses clean criminal records as well. s to govern their legal systems. The developing societies have to learn a few lessons from the practices of the developed ones. Developing nations are having governments that are made out of criminals, and therefore, the entire system is corrupt. The need to have clean justice mechanism is the founding basis of an ideal society. The balancing of power is necessary because if law enforcement officers do not have a fear of inquiry, then, they can use their power in order to hurt public, and in this way, the entire purpose of law enforcement will reduce to nothing.

Conclusion

This paper has an objective of highlighting the operational mechanism of law enforcement that operates under the headship of the judicial system. Law enforcers do not have the freedom of harassing the public by showing of power, and they need strong logical and evidentiary grounds before throwing suspects into custody. Administrative law is a shunt that makes implementation of the constitution possible. All of the local police powers are representative of administrative law, and they need to abide by the clauses of the document in order to keep their jobs intact. They have to satisfy judiciary needs in this regard as well. Rules made by law enforcement agents are of temporary nature, and they can be set under the specific nature of the circumstance. The core objective of law enforcement is to provide a safe environment to the public, whereas, the military officers have to conform to their code of conduct. The military has to take care of foreign elements that may hurt their nation while, the local departments have to ensure compliance of laws in public. The civil punishments have been refined recently, and their severity has been reduced, so that prisoners can experience a second chance to rectify their mistakes. At the end, it is valuable to mention that administrative law does not overpower the police in order to keep them under evaluation.

Explain how through the Administrative Procedure Act and delegation doctrine (or Nondelegation Doctrine), administrative agencies have legislative, judicial, and executive powers. Provide an example of each.

Section 2 – Rulemaking

Explain the differences between substantive rulemaking, interpretive rulemaking, and statements of policy and how each would affect an industry. Use a specific industry, i.e., the airline industry, as an example.

Evaluate how effective the Administrative Procedure Act and delegation doctrine are in maintaining the balance of legislative, judicial and executive powers for an administrative agency. Explain why.
