Namely, does Y's right to be respected in his family life (i.e., not separated from his family) supersede the right of the State to deport an immigrant convicted of a violent crime. The dispute may be said to hinge on the eligibility of Y to invoke Article 8 in this circumstance: does he pose a considerable threat to the UK to such an extent that Article 8 may not be applied? Because his crime was conducted under the influence of alcohol, it may not be argued that Y harbors an intent to commit violent crimes. Therefore, the issue is primarily one of definition and sovereignty.Bibliography
