However, in a situation where, as in this case, the other party relies on that promise to his or her detriment, the promise becomes enforceable. Because Kids Care took a specific course of action in reliance, on Gerard's promise, an enforceable contract was formed (Friedman, 2005; Halbert & Ingulli, 2008

The other potential issue pertains only to the reasonableness of the reliance (Friedman, 2005; Halbert & Ingulli, 2008). For example, if Gerard is an international superstar whose performance could reasonably have been expected to generate sufficient funds to expect that it would actually fund the construction a new facility, the contract would be enforceable. However, if Gerard is a local performer whose performance would be expected to generate only a few hundred dollars, the contract would be enforceable with respect to hiring security guards and refreshment vendors, but not the construction plans for an entire new facility costing many times that amount of money (

Friedman, 2005; Halbert & Ingulli, 2008). In any case, Gerard would likely be held liable to turn over the funds he actually collected from the performance because Kids Care relied to their detriment on his gratuitous promise.
