The Women's 10-hour law would not be legal today. This is because it controlled women through making them feel inferior to men. A good example of this can be seen with the law saying, "The woman's physical structure and the performance of maternal functions place her at a great disadvantage in the battle of life. That while a man can work for more than 10 hours a day without injury to himself, a women, especially when the burdens of motherhoods are upon her, cannot. While a man; can work standing on his feet for more than 10 hours a day continuously without out injuring himself. A woman cannot and that to require a woman to stand upon her feet for more than 10 hours in any one day and perform severe manual labor in the process regularly. This has the effect of impairing her health and that as weekly and sickly women cannot be mothers of vigorous children." These insights are showing how the law allowed someone to legally discriminate against women. This occurred with it acknowledging their inferiority and why they should never be allowed to do anything outside of their traditional roles.

Today, this law would be struck down as unconstitutional. This is because the 14th Amendment guarantees equal protection. The fact that it passed; is showing how this is not occurring in the language and the way it limits what women can do. At the same time, the Civil Rights Act of 1964 prohibits the passage of legislation that will discriminate against someone based upon their race, creed, gender or color. This law allows men to discriminate against women by stereotyping them into specific categories that are focusing on traditional roles. (Gold, 2010)

Yes. Johns Manville is liable for negligence. This is because they knew about the dangers of asbestosis and did nothing. Once their employees became sick, is when they filed a class action lawsuit. The company used the bankruptcy laws to their advantage to shield themselves against similar litigation. This meant that they could use the first settlement as a precedent in the future against other claims. While at the same time, the firm distanced itself from the problem and restructured. This is because the company knew that they could not win the lawsuits and any kind of out of court settlement would have bankrupted them. This is a clear indication of their overall liabilities and the strategy Johns Manville used to avoid responsibility.

Was it ethical of Johns Manville to declare bankruptcy?

It was unethical for Johns Manville to declare bankruptcy. This is because the company knew what would happen and how they can avoid similar issues down the road. The bankruptcy laws were the most effective avenues of achieving these objectives. While employees and their families who were exposed, continued to suffer. This is avoiding their responsibility from the damage that was caused to these people when they were working for the company.

Did Johns Manville meet its duty of social responsibility in this case?

No. Johns Manville should have negotiated a long-term settlement. Then, the firm needed to set aside a percentage of their earnings to cover costs associated with asbestos lawsuits. This would ensure that their workers and families are taken care of. Once this happened, is the point the Johns Manville can decrease the financial impact of the lawsuits and do what is morally correct.
