The mediator does not have a responsibility to help weaker parties. The mediator should focus primarily on the process, helping both sides come to a mutually beneficial solution. However, the mediator should not help the weaker party. Through aiding the weaker party mediators bias will enter into the process. The mediator may become fond of the weaker party and attempt to influence the overall process to favor the weaker party. Through his relationship with the weaker party, the mediator may support them unintentionally as he or she has a more intimate relationship with the party. In addition, who is to determine if a party is "weak?" What signifies a "weak" party? The personification of weak is often subjective. Therefore, the mediator may already have incorporated biases into the overall process. Neutrality is critical in regards to the negotiation process.
